The contribution analyzes the figure of dismissal for “poor performance”, addressing both the case of work performance so limited as to become useless for the employer, and the case of the worker who carries out a large number of absences (but without exceeding the period of I behave). The cases are treated in the light of the jurisprudence, of legitimacy and merit, formed on the matter.
