COLLECTIVE DISMISSAL: WORKERS SELECTION CRITERIA
With the ordinance no. 36451 of November 24, 2021, the Court of Cassation returns to deal with the collective dismissal procedure and, at the end of a motivational path in which the most important precedents are recalled in terms of criteria for choosing the employees to be fired, states that the agreed adoption between the social partners of selection criteria different from the legal ones, as long as they meet the requirements of objectivity and rationality.
